1. About These Terms

These Terms and Conditions (“Terms”) govern your interaction with PK Real Properties (“we,” “our,” or “us”) through our website at pkrealproperties.com, SMS text message communications, and rental services. By using our services or providing your contact information, you agree to these Terms.

2. Rental Services

PK Real Properties is a privately owned residential rental business serving Memphis, Tennessee. Specific rights and obligations relating to a rental tenancy are governed by the signed Residential Lease Agreement between PK Real Properties and the tenant, not by these Terms.

3. SMS / Text Message Service

If you are a tenant who has consented to SMS communications (by signing a lease agreement with an SMS consent section or by signing a separate SMS Consent Amendment), the following applies to messages sent by PK Real Properties:

  • Message types: Rent payment reminders, late payment notices, repair and maintenance scheduling, property maintenance reminders, notices of intent to enter the premises, and lease renewal communications.
  • Message frequency: Message frequency varies based on the circumstances of your tenancy. You may receive several messages per month.
  • Message and data rates: Standard message and data rates may apply based on your mobile carrier plan. PK Real Properties does not charge any additional fees for SMS messages.
  • Opt-out: You may opt out at any time by replying STOP to any text message. You will receive a confirmation of opt-out, and no further SMS messages will be sent.
  • Help: Reply HELP to any text message for assistance, or contact us at pkpropertydirector@pkrealproperties.com.
  • No marketing sharing: PK Real Properties does not sell or share your mobile phone number or SMS opt-in data with any third parties for marketing purposes.
  • Carriers not liable: Wireless carriers (including but not limited to AT&T, Verizon, T-Mobile, and others) are not liable for delayed or undelivered messages.

4. Acceptable Use

You agree not to use any communication channel with PK Real Properties (including SMS, email, phone, or our website) to:

  • Send harassing, threatening, or abusive content
  • Misrepresent your identity
  • Send unauthorized commercial messages
  • Interfere with our systems or services

5. Limitation of Liability

PK Real Properties makes reasonable efforts to deliver SMS messages reliably, but message delivery is dependent on carrier networks and is not guaranteed. We are not responsible for delays, failures, or errors in message delivery caused by carrier issues or other factors outside our control.

6. Changes to These Terms

We may update these Terms from time to time. The most current version will always be posted at this URL. Continued use of our services after changes constitutes acceptance of the updated Terms.

7. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of laws principles.
